Terms of Service

These Terms govern your use of Blind Chat — India's anonymous 1-on-1 chat platform. Please read them carefully before you start chatting.

Effective date: 1 June 2025

⚡ Key Things to Know (Plain-Language Summary)

  • You must be 18 or older to use Blind Chat. We have zero tolerance for minors on the platform.
  • Subscriptions auto-renew unless you cancel before your billing date. You can cancel anytime from your account settings.
  • Chat content is NOT stored after your session ends. Only metadata (IP, timestamps) is retained for 90 days.
  • Sharing illegal content — especially content involving minors — will result in immediate termination and a report to law enforcement.
  • Refunds are available only within 48 hours of a billing cycle starting. After that, no refunds are issued.

By accessing, registering for, or using Blind Chat(the "Platform" or "Service"), you ("User," "you," or "your") agree to be legally bound by these Terms of Service ("Terms"), our Privacy Policy, and all other policies referenced herein. This constitutes a binding contract between you and the operators of Blind Chat ("we," "us," or "our") under the laws of the Republic of India.

These Terms are an "electronic record" as defined under the Information Technology Act, 2000 ("IT Act")and are published in accordance with Rule 3 of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 ("Intermediary Guidelines").

If you do not agree to these Terms in their entirety, you must immediately stop using the Platform. Your continued use of the Platform at any time constitutes your acceptance of the then-current Terms.

By registering or using the Platform, you also consent to receive communications from us — including service notices, billing updates, and legal disclosures — via email, in-app notifications, or other electronic means. These communications are part of our contractual relationship with you.

⚠ Age Restriction: Blind Chat is strictly for adults. You must be at least 18 years of age to use this Platform.

2.1 Minimum Age

You must be at least 18 years of age to create an account or use the Platform. If you are under 18, you are strictly prohibited from accessing or using Blind Chat. We do not knowingly permit minors to use the Service. If we discover a user is under 18, their account will be terminated immediately and any subscription fees will be forfeited without refund.

2.2 Legal Capacity

You represent and warrant that you have the full legal capacity to enter into a binding contract under the Indian Contract Act, 1872. You must not use the Platform if you have previously been prohibited from doing so under any applicable law or court order.

2.3 Geographic Restrictions

The Platform is operated from India. We make no representation that the Service is available or lawful in jurisdictions outside India. If you access the Platform from outside India, you do so at your own risk and are responsible for compliance with your local laws. We reserve the right to restrict access from specific countries at our sole discretion.

2.4 User Representation

By using the Platform you represent and warrant that: (a) you are at least 18 years old; (b) you have the legal capacity to agree to these Terms; (c) your use of the Platform will not violate any applicable law or regulation; and (d) all information you provide to us is accurate and truthful.

3.1 Anonymous Usernames

When you use Blind Chat, you are assigned an auto-generated anonymous username (e.g., "Ghost#4821"). You are not required to provide your real name, phone number, or any personally identifiable information to participate in chats. The Platform is designed for anonymous interaction.

3.2 No Real Identity Required

While you may optionally log in via a third-party authentication provider (e.g., Google), your identity is kept separate from your in-chat persona. We do not display your real identity to other users during anonymous chat sessions.

3.3 Account Security

You are solely responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately at support@blindchat.club if you suspect any unauthorised access to your account. We are not liable for any loss or damage arising from your failure to maintain account security.

3.4 One Account Per User

Each user may maintain only one active account on the Platform. Creating multiple accounts — particularly to evade a suspension or ban — is a material breach of these Terms and may result in permanent termination of all associated accounts without refund.

🚫 Zero Tolerance: Violations of this section, particularly those involving minors, will result in immediate account termination and mandatory reporting to law enforcement.

4.1 Child Sexual Abuse Material (CSAM) — Section 67B IT Act

Strictly prohibited: Any content — text, links, descriptions, or references — that depicts, promotes, or facilitates the sexual abuse or exploitation of children. This is a criminal offence under Section 67B of the IT Act, 2000 and the Protection of Children from Sexual Offences (POCSO) Act, 2012. We will immediately report any such content and the responsible user to the Cyber Crime Cell and relevant law enforcement agencies.

4.2 Sexually Explicit Content — Section 67A IT Act

You may not transmit any content that is sexually explicit or contains material of a sexually explicit nature involving real or fictitious persons, as prohibited under Section 67A of the IT Act, 2000.

4.3 Obscene Content — Section 67 IT Act

You may not publish, transmit, or share content that is obscene, lascivious, or appeals to prurient interest, as defined under Section 67 of the IT Act, 2000 and the Indian Penal Code.

4.4 Harassment, Stalking & Threats

You may not use the Platform to harass, stalk, threaten, intimidate, bully, or abuse any other user or person. This includes sending repeated unwanted messages, making threats of violence or harm, or using language designed to cause emotional distress.

4.5 Solicitation, Trafficking & Exploitation

You may not use the Platform to solicit sexual services, engage in human trafficking, or facilitate the exploitation of any individual. Any such activity is a criminal offence under Indian law and will be reported to authorities.

4.6 Sharing Others' Personal Information

You may not share the personal information of any third party — including their name, address, phone number, financial details, or photographs — without their explicit consent. Such conduct may violate the Digital Personal Data Protection Act, 2023 ("DPDP Act").

4.7 Impersonation

You may not impersonate any individual, organisation, public figure, government authority, or Blind Chat staff member.

4.8 Spam & Automated Bots

You may not use automated scripts, bots, crawlers, or any non-human means to access or interact with the Platform. Sending unsolicited or repetitive messages (spam) is also prohibited.

4.9 Illegal Activity

You may not use the Platform to engage in, promote, or facilitate any activity that is unlawful under any applicable local, state, national, or international law, including but not limited to fraud, money laundering, terrorism, and drug trafficking.

4.10 Text-Only Platform

Blind Chat is a text-only platform. The sharing of images, videos, audio files, documents, or any other media or file type via the chat interface is not permitted. Any links shared must not point to illegal content.

4.11 Hate Speech

You may not publish content that promotes hatred, discrimination, or violence against individuals or groups on the basis of religion, race, caste, sex, gender, sexual orientation, disability, place of birth, or language.

5.1 Monitoring Rights

We reserve the right — but not the obligation — to monitor, review, and moderate content transmitted through the Platform for compliance with these Terms and applicable law. As an intermediary under Section 79 of the IT Act, we act on complaints received rather than proactively surveilling all chat content.

5.2 Reporting Violations

If you encounter content or conduct that you believe violates these Terms or applicable law, please report it immediately to our Grievance Officer at grievance@blindchat.club. Your report should include: (a) a description of the violation; (b) the approximate time and date; and (c) any supporting information. All reports are treated confidentially.

5.3 Takedown Timelines

  • Illegal content (CSAM, terrorist content, obscene content violating IT Act): Removed within 24 hours of a valid complaint being received.
  • Other violations (harassment, spam, impersonation): Addressed within 72 hours of a valid complaint.

5.4 Termination for Violations

We reserve the right to suspend or terminate your account immediately and without prior notice if we determine, in our sole discretion, that you have violated these Terms or any applicable law. See Section 11 for full details on account suspension and termination.

5.5 Zero Tolerance — Child Safety

Any user found to have shared, requested, or facilitated content involving the sexual exploitation of minors will be permanently banned without appeal and will be reported to the National Crime Records Bureau (NCRB), the Cyber Crime Cell, and/or relevant law enforcement authorities without exception.

In accordance with Rule 4 of the Intermediary Guidelines, 2021, we have designated a Grievance Officer to address user complaints and concerns. The details of our Grievance Officer are:

6.1 Response Timelines

  • Acknowledgement: Within 24 hours of receiving your complaint.
  • Resolution: Within 15 days of acknowledgement for most complaints.
  • Complaints related to content violating dignity of women (under Section 67A IT Act or similar) will be resolved within 24 hours.

6.2 Escalation Path

If your complaint is not resolved to your satisfaction within the specified timelines, you may escalate the matter to:

  • The Ministry of Electronics and Information Technology (MeitY) grievance portal.
  • The Cyber Crime Cell of your local police station.
  • The National Cyber Crime Reporting Portal at cybercrime.gov.in.

Free tier users have access to basic anonymous chat with daily time limits. Feature details may change; current features are displayed at the time of purchase.

7.2 Auto-Renewal

⚠ Important — Auto-Renewal: All subscription plans automatically renew at the end of each billing cycle (monthly) unless you cancel before the renewal date. By subscribing, you expressly authorise us to charge your saved payment method for the renewal amount. You will receive a reminder email at least 3 days before each renewal.

7.3 Payment Processing

All payments are processed securely by Razorpay(Razorpay Software Private Limited), a licensed payment aggregator regulated by the Reserve Bank of India. Your card and banking details are handled by Razorpay and are not stored on Blind Chat's servers. Transactions are subject to Razorpay's terms and conditions.

7.4 Refund Policy

  • Refund requests submitted within 48 hours of a billing cycle starting are eligible for a pro-rated refund for the unused portion of the subscription.
  • No refunds will be issued after 48 hours from the start of a billing cycle, except as required by applicable law.
  • Accounts terminated for violation of these Terms are not eligible for any refund.
  • To request a refund, email support@blindchat.club with your registered email address and transaction ID.

7.5 Cancellation

You may cancel your subscription at any time from your account settings or by contacting support@blindchat.club. Cancellation takes effect at the end of the current billing period. You will retain access to paid features until the end of the period for which you have already paid.

7.6 Price Changes

We reserve the right to change subscription prices. We will provide at least 30 days' advance notice of any price changes via email and in-app notification. If you do not cancel before the price change takes effect, your continued use constitutes acceptance of the new pricing.

7.7 Consumer Protection

All subscription transactions are subject to the Consumer Protection (E-Commerce) Rules, 2020. If you have a billing dispute, please contact us at support@blindchat.club before initiating a chargeback. Frivolous chargebacks may result in account suspension.

Your privacy is important to us. This section provides a summary of our data practices. Our full Privacy Policy provides complete details and is incorporated into these Terms by reference.

We comply with Section 43A of the IT Act, 2000, the IT (Reasonable Security Practices and Procedures) Rules, 2011, and the Digital Personal Data Protection Act, 2023 ("DPDP Act").

8.1 Data We Collect

  • Technical data: IP address, device type, operating system, browser type and version.
  • Session metadata: Chat session timestamps, session duration, matchmaking data.
  • Account data: Email address (if provided via Google login), anonymous username, subscription status.
  • Payment data: Transaction IDs and billing records (processed by Razorpay; we do not store card details).

8.2 What We Do NOT Collect

Chat content is NOT stored. The content of your conversations — the actual messages you exchange with other users — is transmitted in real time and is not retained on our servers after the session ends. We do not read, log, or analyse your chat messages.

8.3 Purpose of Data Collection

  • Operating, maintaining, and improving the Platform.
  • Preventing fraud, abuse, and illegal activity.
  • Complying with legal obligations and responding to law enforcement requests.
  • Processing payments and managing subscriptions.
  • Communicating with you about your account and service updates.

8.4 Data Retention

  • Session metadata and technical logs are retained for 90 days and then permanently deleted.
  • Account data is retained as long as your account is active and for 30 days after deletion.
  • Payment records are retained as required by Indian financial regulations (typically 5 years).

8.5 No Sale of Data

We do not sell, rent, or trade your personal data to third parties for their marketing or commercial purposes.

8.6 Right to Erasure

Under the DPDP Act, 2023, you have the right to request deletion of your personal data. To exercise this right, email support@blindchat.club from your registered email address. We will process your request within 30 days, subject to legal retention obligations.

8.7 Security Measures

We implement industry-standard security measures including TLS/SSL encryption for data in transit, access controls, and regular security audits. However, no system is entirely secure and we cannot guarantee absolute security.

9.1 Intermediary Status

Blind Chat is an intermediary as defined under Section 2(1)(w) of the IT Act, 2000. We provide a platform for users to communicate with each other. We are not the author, publisher, or speaker of any user-generated content transmitted through the Platform.

9.2 No Endorsement

We do not endorse, verify, or take editorial responsibility for any content transmitted by users. We are not liable for the accuracy, legality, appropriateness, or quality of user-generated content.

9.3 Safe Harbour Protection — Section 79 IT Act

We avail the safe harbour protection provided under Section 79 of the IT Act, provided that:

  • The transmission of the offending content was initiated by a third-party user.
  • We did not select, modify, or initiate the transmission.
  • We act expeditiously to remove or disable access to offending content upon receiving actual knowledge of it, either through a court order or a government notification.
  • We have published and enforced these Terms and the Intermediary Guidelines as required.

9.4 Cooperation with Law Enforcement

We will fully cooperate with law enforcement agencies, courts, and government authorities. Upon receiving a lawful request, court order, or government direction, we will disclose available user information including IP addresses, session metadata, account details, and any other retained data as required by law.

10.1 Platform Ownership

All intellectual property rights in and to the Platform — including but not limited to the user interface, design, graphics, branding, logo, software, source code, algorithms, database structure, and written content — are owned by or licensed to Blind Chat. These are protected under the Copyright Act, 1957 and other applicable Indian and international intellectual property laws.

10.2 User Content Ownership

You retain ownership of the messages you compose and transmit through the Platform ("User Content"). However, given that chat content is not stored after session end, your User Content exists only transiently for the purpose of real-time delivery.

10.3 Licence Grant

By transmitting User Content through the Platform, you grant us a limited, non-exclusive, royalty-free, worldwide licence to transmit and display that content solely for the purpose of operating the Service (i.e., delivering your messages to the intended recipient in real time). This licence expires immediately upon the end of the chat session. We make no other use of your message content.

10.4 Restrictions

You may not:

  • Copy, reproduce, scrape, or extract any part of the Platform's UI, branding, or code.
  • Reverse-engineer, decompile, or disassemble any part of the Platform software.
  • Create derivative works based on the Platform without our written permission.
  • Use our trademarks, logos, or branding without prior written consent.

11.1 Immediate Suspension (No Warning)

The following violations will result in immediate account suspension without prior notice:

  • Any conduct involving CSAM or child exploitation.
  • Any conduct violating Sections 67, 67A, or 67B of the IT Act.
  • Criminal activity, threats of violence, or terrorist content.
  • Fraudulent transactions or chargebacks.
  • Operating multiple accounts to evade a ban.

11.2 Warning-Based Suspension

For less severe violations (e.g., minor harassment, spam, impersonation), we may issue one or more warnings before taking further action. Repeat violations after a warning will result in account termination.

11.3 No Refund on Termination for Cause

If your account is terminated due to a violation of these Terms, no refund will be issued for any remaining subscription period, regardless of when in the billing cycle the termination occurs.

11.4 Right to Appeal

If you believe your account was suspended or terminated in error, you may submit an appeal within 7 days of the suspension notice to appeal@blindchat.club. Please include your registered email address, the reason for your appeal, and any supporting evidence. We will respond within 15 business days. Our decision on appeal is final.

11.5 Platform Discontinuation

We reserve the right to discontinue, suspend, or terminate the Platform entirely at any time. In such an event, we will provide at least 30 days' advance notice via email and in-app notification, and will offer pro-rated refunds for any unused subscription periods, except as prohibited by law.

12.1 "As Is" Disclaimer

The Platform is provided "as is" and "as available" without any representations or warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted service.

12.2 No Uptime Guarantee

We do not guarantee that the Platform will be available at all times. The Service may be interrupted due to maintenance, upgrades, technical failures, force majeure, or other causes. We are not liable for any loss arising from service interruptions.

12.3 Not Liable for User Interactions

We are not liable for any harm, distress, loss, or damage arising from interactions between users on the Platform. You use the Platform at your own risk. We strongly encourage you to exercise caution and good judgment when interacting with strangers online.

12.4 No Liability for Indirect Damages

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, emotional distress, reputational harm, or business interruption, arising from or related to your use of the Platform.

12.5 Liability Cap

Our total aggregate liability to you for any claim arising out of or relating to these Terms or the Platform shall not exceed the total subscription fees paid by you to us in the three (3) months immediately preceding the event giving rise to the claim, or ₹1,000 (Indian Rupees one thousand), whichever is greater.

You agree to indemnify, defend, and hold harmless Blind Chat and its officers, directors, employees, agents, contractors, and licensors from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from or related to:

  • Your use of, or inability to use, the Platform.
  • Your violation of these Terms or any applicable law or regulation.
  • Your User Content or any content you transmit through the Platform.
  • Your violation of the rights of any third party, including privacy rights, intellectual property rights, or rights to personal safety.
  • Any claim by a third party arising from your conduct on the Platform.

This indemnification obligation shall survive the termination of your account and these Terms. We reserve the right to assume exclusive control of the defence of any matter otherwise subject to indemnification by you.

14.1 Informal Resolution First

Before initiating any formal proceedings, you agree to first attempt to resolve any dispute informally by contacting us at legal@blindchat.club with a written description of your complaint. We will make a good-faith effort to resolve the matter within 30 days of receipt. Many disputes can be resolved quickly this way.

14.2 Arbitration

If informal resolution fails, any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or invalidity thereof, shall be settled by binding arbitration under the Arbitration and Conciliation Act, 1996 (as amended). The arbitration shall be conducted by a sole arbitrator mutually agreed upon by the parties, or, failing agreement, appointed in accordance with the said Act.

  • Seat of Arbitration: Siliguri, West Bengal, India.
  • Language: English.
  • Award: The arbitral award shall be final and binding on both parties.

14.3 Governing Law

These Terms are governed by and shall be construed in accordance with the laws of the Republic of India, without regard to its conflict of laws principles.

14.4 Jurisdiction

For matters not subject to arbitration (including urgent injunctive relief), the parties submit to the exclusive jurisdiction of the competent courts located in Siliguri, West Bengal, India.

15.1 What Are Cookies

Cookies are small text files stored on your device when you visit our Platform. We use cookies to enable core Platform functionality, remember your session, and understand how users interact with the Platform.

15.2 Types of Cookies We Use

  • Session cookies: Temporary cookies that expire when you close your browser. Used to maintain your login state and chat session integrity. These are essential for the Platform to function.
  • Analytics cookies: Used to collect aggregated, anonymised data about how users navigate the Platform (e.g., pages visited, time on page). This helps us improve user experience. We use privacy-friendly analytics tools; no personally identifiable data is shared with analytics providers.

15.3 How to Disable Cookies

You can control and delete cookies through your browser settings. Refer to your browser's help documentation for instructions. Please note that disabling cookies may impair the functionality of the Platform — in particular, disabling session cookies will prevent you from logging in.

We shall not be liable for any failure or delay in performing our obligations under these Terms to the extent that such failure or delay is caused by circumstances beyond our reasonable control, including but not limited to:

  • Acts of God, natural disasters, floods, earthquakes, or pandemics.
  • Acts of government, war, civil unrest, terrorism, or sanctions.
  • Strikes, labour disputes, or industrial action.
  • Internet backbone failures, large-scale DDoS attacks, or failures of third-party infrastructure providers.
  • Power outages or telecommunications failures beyond our control.

In the event of a force majeure event, we will notify you as soon as reasonably practicable and make reasonable efforts to resume the Service promptly. Subscription billing will be paused for the duration of any extended service outage caused by force majeure.

We reserve the right to modify, update, or replace these Terms at any time. When we make material changes, we will:

  • Update the "Effective Date" at the top of this document.
  • Provide at least 15 days' advance notice of material changes via email to your registered address and/or via an in-app notification banner.

Your continued use of the Platform after the notice period constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must cancel your subscription and stop using the Platform before the changes take effect. We recommend reviewing these Terms periodically.

These Terms are drafted to comply with the Information Technology Act, 2000, the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, the Digital Personal Data Protection Act, 2023, and the Consumer Protection (E-Commerce) Rules, 2020.
